1Purposeand Scope

These General Terms and Conditions of Sale (“GTC”) govern the sale of products on vertigetall.com between VertigeTall OÜ (“the Seller”) and any person making a purchase (“the Customer”). Placing an order implies unconditional acceptance of these GTC.

2. Seller's Identity

3Products

The products offered—jeans, chinos, pants, shirts, polo shirts, T-shirts, sweaters, jackets, and suits—are designed exclusively for tall and very tall men, up to approximately 2.20 m. The lengths, fits, and proportions are tailored specifically for these body types.

Descriptions and photographs are provided for informational purposes only and are not binding on the Seller in the event of minor visual differences. Products are offered while supplies last.

4Price

Prices are listed in the currency displayed based on the country of delivery, including all applicable taxes. The Seller reserves the right to change its prices at any time; the applicable price is the one in effect at the time the order is confirmed.

Shipments outside the European Union (United Kingdom, United States, Canada, Switzerland): All shipments are made on a DDP (Delivered Duty Paid) basis. The Seller is fully responsible for any applicable customs duties and import taxes. The price displayed at the time of order is the final price: the Customer will not be charged any additional fees upon delivery.

5Order

The Customer confirms the order after reviewing the details and the total price. The sale is considered final upon confirmation of the order and receipt of payment. A confirmation email summarizing the order is sent to the Customer upon confirmation.

Any request for a change or cancellation must be submitted in writing to contact@vertigetall.com before the package is shipped. After this deadline, the order can no longer be canceled.

6Payment

Payment is made online, securely, using the following methods:

• Credit card (Visa, Mastercard, American Express) via Shopify Payments
• PayPal,
• Any other payment method offered at the time of order

All transactions are protected by SSL encryption and processed by reputable payment service providers. The Seller never has access to the Customer's banking information. The order is processed only after payment has been successfully confirmed.

7Delivery

Orders are processed and shipped within one business day after payment is confirmed. A tracking number is automatically sent to the Customer via email as soon as the order is shipped.

The delivery times listed are estimates and may, in exceptional cases, vary depending on the carrier or local formalities. The Seller shall not be held liable for delays attributable to the carrier or to external events.

8Rightof Withdrawal

In accordance with European regulations, consumer customers have 14 days from the date of receipt of their order to exercise their right of withdrawal, without having to provide a reason.

To exercise this right, the Customer must notify the Seller of their decision in writing, either through their VertigeTall account or by emailing contact@vertigetall.com. The Seller will then provide the Customer with return instructions.

Return Policy: The garment must be returned new, unworn, unwashed, and with all original tags intact. Any item returned in a condition that does not meet these requirements may be refused.

Return Shipping Costs: The Customer is responsible for return shipping costs, according to the following rates:

• 🇺🇸 United States: $12.90
• 🇨🇦 Canada: CAD 12.90
• 🇨🇭 Switzerland: CHF 12.90

9Returns, Exchanges, and Refunds

After receiving and inspecting the returned product, the Seller will proceed, at the Customer’s discretion, as follows:

• an exchange for a different size or style, subject to availability;
• a refund, issued within 14 days of receiving the return, via the same payment method used when placing the order.

No returns will be accepted without a prior written request. The Seller reserves the right to refuse any returned item that does not comply with the conditions set forth in Article 8.

10 Warranties

The products are covered by the statutory warranties applicable within the European Union, including the statutory warranty of conformity and the warranty against hidden defects. Customers are encouraged to contact the Seller at contact@vertigetall.com with any questions regarding a defective or non-conforming product.

11Liability

The Seller shall not be held liable for any inconvenience or damage resulting from the use of the Internet, including, but not limited to, service interruptions, unauthorized access, or computer viruses. The Seller shall not be held liable for delivery delays attributable to the carrier or to events of force majeure.

12Personal Information

Customer data is collected and processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR). It is used exclusively for the purposes of order processing and customer relations.

13. Governing Lawand Disputes

These Terms and Conditions are governed by Estonian law, without prejudice to the mandatory consumer protection provisions of the Customer’s country of residence within the European Union.

In the event of a dispute, an amicable resolution will be sought as a matter of priority. Consumer customers may also use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
